My dad and I ran into a trespasser last year. We were shed hunting and so was he. We were really nice to him. Asked him how his day was going and what he was doing. We then left and took pictures of his car. Once we had the info we turned it all over to the landowner and he then when to the police. He was given a warning although it turned out he was a cop from a couple towns over and probably felt more than the warning. Tacklebox I would not hold back. We are not talking a felony we are talking a ticket for trespassing & his *** deserves it.
I actually had something similar last night. Not owning the land I hunt leaves me with little options, but if I was you I'd do whatever I could, yea your never gonna stop trespassing but may make this guy thing twice next time. Some opinions surprise me on this, ond in particular, it has nothing to do with scaring off a deer. It has to do with the fact that you don't let people do as they please on what you own. If you came home to your house and somebody was there would you just say "sir this is my house, please leave" hell no you wouldn't. Besides the fact what if this idiot woulda climbed into one of your stands and fell out. Are you ready to go to court ovrr that? That happens around here couple different times Ican remember, or thd person was riding a 4 wheeler, wrecked and got hurt. The land owner got sued for hospital bills. I'd say do whatever you think is right and need to do.
to be fair, this information wasn't in your original post. I pictured some guy walking through the woods and scaring off your deer, and you going berserk I still think more information is needed before I would go ahead and say prosecute. 1. Our family owns a pretty big chunk of land, but not in the state most of us reside. Trespassing is something we have had to deal with. Because we aren't there 100% of the time, we allow the neighbors to hunt our property (and they allow us to hunt theirs). When we go up to hunt our farm and we are heading out, we sometimes come across people we are not familiar with. If we went off running our mouth on every person holding a bow or gun we would probably lose access to the surrounding properties, and MORE people would probably trespass on our property throughout the years. What did he say when you confronted him? Is their state hunting land surrounding your property where he could have come in from accidentally? Is there hunting club property? Is he new to the area? Now, if it turns out he lives local, and there isn't any state game land, or he didn't just join a hunt club, and he came through with a bow and bait, I think you are absolutely in your right to prosecute. I am just very hesitant to prosecute someone without a lot of details, all of them pointing to the fact he was blatantly trespassing.
No public land for miles. He claimed to have permission on neighboring property I called to verify and found he was lying. Also I didn't go completely crazy on the dude. I did make myself VERY clear. When I asked him to hang out while I made a call he ran off also didn't want to give me his name. These are not things an inoccent person does. He knew what he was doing
U did the right thing. Now it's on record, the law will check for priors(but will only find REPORTED incidents) and he may not do it again. Just watch yourself when you go back out: keep your phone handy and always let someone know when going out and to check up on you to be safe.

Yeah I would prosecute now that we know all the extras. Is baiting legal in Kansas? You might be able to get him on that too if the video is good enough. If it was a kid or someone not hunting I probably wouldn't. Was it in the middle of your property or on an edge? I had a guy on trail cam last year around midnight with a headlamp and gun. Didn't get a face so I couldn't do anything. If I had his face I would've.
Yup crazy talk! Seriously though, you were pretty confident before that he was pretty protected from poachers and other hunters, but now we know better. That dude would not have passed on him and he may have actually seen him before & that's why he risked trespassing. Wait... He was carry bait... Maybe he was squirrel hunting?
