Would you prosecute

    Sooooooo.......... tonight I had the Backyard Buck @ 50 yds chasin 3 does and some ****** comes walkin in on me and blows them out of the field. I get pissed ( naturally) and confront the dude. He starts mumbling and I scare the **** out of him and run him off. Little did he know I recorded the confrontation.... A couple hours later I run into the guy at our lil small town bar. ( I had on a face mask in the field he had know idea who I was) I call the cops and explain the situation. (shoulda called earlier but I didn't..... was sooo pissed) First they didn't want to do much, then I showed the video from my iPhone that was mounted to my bow. We now have a court date... so what say you.... Would you pursue charges?????? I am so bummed right now. Plus side is he didn't really spook him bad, he just kinda chased the does back to the other end, but still....

    was he trespassing ?
    did he threaten you ?

    I would. Hes not allowed there and he screwed up your hunt. Its up to you though.

    I doubt prosecution would be the topic if he wasn't trespassing. ...and yes I would to the fullest extent...its the only way they learn

    It's hard to say on not being there and experiencing it. If he was in camo I would be all over him, knowing then that he A. knew he wasn't suppose to be there . B. Was either hunting or up to no good. If he didn't have a bow or another weapon I would prolly lean to the side of if I ever catch you around again you will have charges pressed against you for trespassing and anything else I could get him for.

    Think of it this way,will you ever get it on video again? Or will he have three of his buddies with him next time and you will be the one looking for backup. I say get the guy into court.

    I"m not prosecuting, that is absolutely ridiculous. The fact you called the cops after the fact, is astounding.

    Really upset you didn't kill the deer today huh? Lighten up. Maybe instead of yelling like some crazy person the first time, you have a conversation with him, ask him what he's doing, explain the situation, and take a breather.

    I generally give them a stern talking to and a warning (one they will never forget) and then if I catch them back on my property again, I detain them and call the sheriff.
    Catching them poaching or with game already on hand is another matter...luckily I've never gotten into a knock down drag out yet with a trespasser.

    Really? Its a deer hes trying to kill on HIS property amd some idiot trespasser scares him off. He has every right to prosecute

    We have a zero tolerance trespass policy at the farm. Get him.

    What is more tactful than the letter of the law? I didn't hit the guy. I chewed his butt and he ran for the hills.

    No stand? If not he probably has a setup on your ground, one he's already hunted. I'd prosecute

    More details please.
    Was he a kid?(I'm 43,if you're young enough that I could be your dad,I consider a kid). I did some really stupid stuff when I was a kid. I'd be more forgiving with a kid. Grown man,not as much.
    What was his excuse? Did he sincerely believe he had permission to be there? Good people make honest mistakes. Or did he blatantly have no idea who he was on or where he was supposed to be and didn't care? I caught a guy one time on our property that made a honest mistake. He had never hunted the neighbor farm and didn't know where the lines were. I considered that my fault by not having it marked. I got permission on some property last week that the land owner isn't for sure where his lines are.
    Also,I think most importantly, does he live there? Myself,I think the last thing you'd want to do is piss off a guy that lives right next to your property and start a "war".

    Are you a land owner? I doubt it. The only way to stop trespassing is to prosecute the offenders. Then the message gets out you don't mess around and won't tolerate trespassing.

    You carry your bait in a grocery bag? Joking... This was him? If he was in the act of hunting on your property I might prosecute, but you have to consider the ramifications not positive and negative for you and your family. Ultimately will it accomplish your goal of preventing trespassers? Probably not...
