Throwing cigarettes out car window---littering? Deserving of a littering ticket?

    Littering for sure. I hate pulling up to a stop and seeing a huge pile of cigarette butts sitting in the gutter.

    So there are a lot of people here that seem to think they should be given the ticket (Myself included), so in an effort to stir the pot, lets throw this out there.

    It's easy for us as non-smokers to say write the ticket but lets bring it a little closer to home. Do you would think that leaving behind a gut pile from a deer should be considered littering? Just like the butts, it is waste and it would definitely be offensive to some people.

    For the record I don't consider it littering because it's more beneficial to leave it there rather than bring it out, but I'd like to hear your guys opinion of why throwing butts out the window would be considered littering and this would not?

    If the law was I needed to dispose the guts I would do so.

    As you know a day later they are all but gun.

    I don't consider leaving a gut pile to be littering, that thing will be gone by the next morning around here :lol:

    As far as cigarette butts go, I think it is the same thing as if I were to throw an empty chew can out the window. No one wants to see that on the road, and it is not biodegradable. I'm sure I would get a ticket if I actually threw one out and a cop saw it, and I would not be upset with the cop at all. Same should go for smokers.

    If I saw some one tossing a gutpile out the window onto a street or sidewalk I would fully expect them to get a ticket.

    It's not just out the windows of vehicles, you can look around and find butts all over the place. In general smoking is a nasty habit an unfortunately the actions of some( not all) smokers do plenty to reinforce the nastiness of it.

    I'm willing to bet 99% of smokers throw their butts where ever, when ever they please......except in their own ash trays, yards, driveways, pools, garages, front porches etc.....well, you get the point!

    § 33.1-346. Dumping trash, companion animals, etc., on highway, right-of-way or private property; penalty.


    A. It shall be unlawful for any person to dump or otherwise dispose of trash, garbage, refuse, litter, a companion animal for the purpose of disposal, or other unsightly matter, on public property, including a public highway, right-of-way, property adjacent to such highway or right-of-way, or on private property without the written consent of the owner thereof or his agent.


    B. When any person is arrested for a violation of this section, and the matter alleged to have been illegally dumped or disposed of has been ejected from a motor vehicle or transported to the disposal site in a motor vehicle, the arresting officer may comply with the provisions of § 46.2-936 in making such arrest.


    When a violation of the provisions of this section has been observed by any person, and the matter illegally dumped or disposed of has been ejected or removed from a motor vehicle, the owner or operator of such motor vehicle shall be presumed to be the person ejecting or disposing of such matter. However, such presumption shall be rebuttable by competent evidence.


    C. Any person convicted of a violation of this section shall be guilty of a misdemeanor punishable by confinement in jail for not more than 12 months and a fine of not less than $250 or more than $2,500, either or both. In lieu of the imposition of confinement in jail, the court may order the defendant to perform community service in litter abatement activities.


    D. The governing bodies of counties, cities and towns are hereby authorized to adopt ordinances not in conflict with the provisions of this section, and may repeal, amend or modify such ordinances.


    E. The provisions of this section shall not apply to the lawful disposal of such matter in landfills.

    So what if they were bananas peels instead of cigarette butts? Would it bother you less, more, not at all?

    when i smoked i would never throw a but out when a car was about to go by and if there was a car behind me i would throw it down twords the road instead of up in the air and give the but a chance to hit the car behind me. if i ever was smoking in a parking lot i would flick the cherry off smash it and put the filter in the back of my truck i have sence then quit smoking and chewing but thought i was as respectful as one could about it.

    just had this on my mind i thought it had to be so many onces of whatever it was before you could be givin a ticket? someone led me to belive that just the filter wasnt enough to write a ticket for.

    So is my poooo. Litter is litter no matter how we look at it. Some things are just more acceptable to society then others. Nothing pisses me off more when I am fishing and there are 1000s of butts laying all over the place.

    I think the prisoners should pick them up...lol. It would give them something to do besides work out, watch cable Tv, and lay around...lol. The liberals might call that cruel though. Lets us know how it goes if you write one.

    What about speeding? Should cops pull over and give tickets to every person who goes 1 mph over the speed limit? After all, a law is a law.
