About a week ago my son had a very and I mean very very minor fender bender, in fact so minor no fenders were bent but both drivers side front bumper corners were very lightly damaged.. The police show up no tickets issued but on the report they did say it was my sons fault no problem so far, they ask everyone involved if anyone was hurt everyone was fine in fact the other driver said they were going to slow to get hurt... FAST FORWARD yesterday I get a call from our insurance company the passenger is now claiming to be injured, I can't say I didn't see this coming, Anyway this should be fun.... Times like this I am so glad my wife is an insurance agent....
If it is not in the accident report you should know the answer...did not happen same as refusing medical treatment at the time of the accident. Look at the report and see if they were wearing seat belts will also be a factor and did they have current auto insurance and registration to be on the road in the first place. Hate to say it but sometimes you have to look at all the facts as any insurance agent would. Good luck.
that is what is mildly amusing it's all in the report right down to the fact they said they were fine, and both parties drove away, now they are claiming and injury and want their 1999 Honda civic totaled.... heck my sons car is a 1989 civic wagon prolly made of old PBR cans and it is fine...
The claims guy will look at both cars and make there final on all repaires to be done, I would not sweat it either way and let the official police report do the talking past that offer no more statements then that .and that goes triple to the other party's insurance company refer them only to your agent and be done with it.
