Text message sender may be held responsible for car crash

    If a car accident is caused by reading a text message, who is to blame? The driver or the sender of the text message? Up until now it has been the driver, but that may change.

    Shannon Colonna was merely texting her friend Kyle Best when he slammed his car into a New Jersey couple riding on a motorcycle one early morning in September of 2009.
    Now a judge may hold her partially responsible for David and Linda Kubert’s severe injuries, after the couple filed a lawsuit in which they claim she knew her teenage friend was driving — and texted him anyway, the couple’s lawyer, Stephen “Skippy” Weinstein told the Daily News.

    The Kuberts, who both lost their left legs because of the horrific crash, launched a public campaign against texting while driving shortly after the accident.

    So should she be charged?

    Hell no. Just because she sent a text doesn't mean she forced the driver to look at the phone.

    That is just ignorant! How is the sender suppose to know where the receiving party is at? Secondly, did the sender hold a gun to the receiving parties head and make him read the text? I just shake my head... I have no faith in the judicial system for even entertaining the idea!

    This is ridiculous! Even if she knew he was driving, she did not make him pick up the dang phone and read the message. Leave it to an attorney named "Skippy" to come up with a lame-brained theory like that!

    I think it's also Verizon's fault for allowing the girl to send the text when she knew she was driving. Their network should be able to read the senders mind.

    I guess people she be charged for reading billboards. Maybe I should run off the road and claim whiplash when the virginia lottery hits $600 million again.

    This is so f'n rediculous! Getting so sick of hearing about lawsuits like this. Hope after this gets dismissed in court that someone beats the snot out of Skippy!

    Lawsuits have been getting out of hand for awhile....It isn't so much a flaw with our legal system so much as a look into the corrupt mindset of the average person in America these days. No one wants to work for anything. Find a hand out or pay day at someone else's expense and don't worry about it.

    I try to not be judgmental but one of the WORST things one could admit to me is suing another. I have acquaintances who are gay (even tho I believe it is wrong personally), I have alcoholic friends, friends who do illegal drugs, friends that cheat on taxes, friends that don't cut their fingernails regularly.....I can say however I almost never associate with the type of person who sues another without pretty severe circumstances.

    So I guess if I'm reading the bh.com forums on tapatalk and get into an accident Todd is to blame!!! Maybe I should bookmark Peta's website and soon as I get in an accident pull up the page and blame them!

    I'm guessing the sender has deeper pockets. It's all about money and free rides. I'm not saying the people weren't greviously hurt with limbs lost and everything. But really... suit the sender? That's insane.
