SB 850 Hunting; allows a person to hunt any wild bird or wild animal on Sundays. 01/31/11 Senate: Failed to report (defeated) in Agriculture, Conservation and Natural Resources (2-Y 13- YEAS--Petersen, Marsden--2. NAYS--Ticer, Whipple, Hanger, Watkins, Reynolds, Puckett, Ruff, Blevins, Obenshain, McDougle, McEachin, Northam, Stuart--13. ABSTENTIONS--0. There's a lot of bummed out hunters in VA right now. Quite frankly it doesn't bother me either way. Personally I spend Sunday as time for me and the wife. If I could hunt on Sunday I wouldn't.
I hope we have a ban on Sunday fishing as well. I hope we also ban all sales of firearms, ammunition, and hunting and fishing supplies on Sunday here in the great state of Virginia. That includes all online sales. If your IP address comes up as being from Virginia, then your purchase cannot be completed by any company that sells the above listed items.
What?? You want to be banned from owning land on Sundays ?? I am all for it if that is what you want !!!! :D Tim
Yes TJF, now that is an idea. I think we should relinquish our land ownership on Sundays so that the governmen can assume full ownership for 24 hours. I will write my congressman.
If he's going where I think he's going.....this isn't a weird statement....AT ALL. Think about it. And, understand the laws of your state (I say that with no condescending tone). You could "probably" hunt on Sundays, right now in VA, on your own land. And there probably isn't a damned thing they could do about it.
I feel for you guys. I love to watch God's creations walk by at 20 yards on a nice Sunday. I dont get this law at all. Why isnt it a law requiring you guys to go to church on those days then. Stupid government
I know but I still managed to some how find humor in it. Had to snicker... then post... then snicker some more. Had nothing to do with thinking it was a weird statement as I didn't. I will try to walk away the next time without posting and save you guys from my bad humor. I promise !!! Tim
oddly...that is coming up again, happens just about every year, and for some reason always 40 days before the Easter bunny comes
Coming from another Sunday-less hunting state, I feel your pain. This is probably THE law I have the most problems with. And further more, my fellow "hunters" who support the sunday hunting ban, I have less respect for than a PETA die hard.
Well I am not taking this laying down. I am getting active - emailing. The NO voters need to explain themselves this is unconstitutional.
Before you send that email.....what's unconstitutional? Why? Don't cite "separation of Church and state". That dog won't hunt.
Simply - Sunday is a day like any other, there is nothing in the US Constitution that says otherwise. SO - Since I am doing something already deemed nationally, and statewide to be legal I do not feel that Virginia has any basis to decide Sunday is different than any other day as far as my right to enjoy my free time doing something completely LEGAL on PRIVATE PROPERTY. Its more about VA Politicians needs to tell me why I can't, and I will see if their reason is constitutional. I find it unlikely.
I hunt maybe 2 Sundays a year...but that doesn't matter - I would do anything possible in my State to overturn this. Your power is in #'s, you will have no luck approaching this yourself....Good Luck!
The consitutional issues I see are "equal protection" in nature. Another one that comes to mind but is rarely used is, "Please, pretty please government stay the hell out of my business...thank you". "Generally, the question of whether the equal protection clause has been violated arises when a state grants a particular class of individuals the right to engage in an activity yet denies other individuals the same right. " And a particular group of people that are hurt by not allowing them to hunt on Sundays are Jews. They are not allowed to work on Saturdays as this is their Sabbath. I am using them as the strict scrutiny requires to prove that the equal protection clause was violated.
Hunting is a privilege, not a right. Therefore your State government can regulate it any way they see fit - including not allowing you to hunt on Sundays. In fact, if they wanted to they could tell you that you can't hunt at all. Your argument that what you're doing on private property can't be regulated is absurd. If that were the case you'd be able to hunt 24x7, 365 days a year, and kill as many animals as you wanted as long as it was on your own land. I agree 100% that the ban on Sunday hunting is completely ridiculous and not based on any real facts or sound reasoning, but fighting it as 'unconstitutional' is a waste of your time and energy. You'd be better for spreading your message to the people who live in the districts of the politicians who voted to uphold the law. Let their voices be heard the next time a vote comes up.
