Not defending the kid. Just found it ironic they never asked or checked if he had been drinking when that was the reason for the road block. I also found it ironic the k9 did the same as what happened to a co worker. He had been pulled over 7 times leaving work in just a few months. Got tired of it and said no and the dog tore his car up for it. (This guy is a dbag and recently released from prison so im sure he is being watched but that's no reason to pull him over for no reason)

    Are road blocks even constitutional?

All im sayin is the guy provoked a negative reaction....the cop being right or wrong has nothing to do with my point....the guy was acting like a jerk to the cop...the cop happened to react badly.....had guy started the convo with good evening officer how are you tonight and acted like a friendly person he prolly would have been through in less than a minute or two....being a jerk to try and prove a point with a YouTube video is what this guys about....acting like everyone's out to get you

You'd be surprised how many times someone has extended their hand and thanked me, after handing them a citation or dropping them off at the jail intake. Every department is different, but we're trained to be respectful, polite and courteous to the even the worst offenders. However, we're also trained to keep the upper-hand in any scenario. This is to protect ourselves. There was fairly recent study performed, using lifers and death-row inmates. They were asked questions as to why they assaulted/killed cops. Their answers were nearly unanimous; they did it to avoid prison AND because they sensed weakness in the officer... they "knew they could do it". This is why when you give an officer an attitude, it's usually "seen & raised" by the officer. It's how we ensure we're going home to our families at the end of the shift. But if you're respectful and polite, you're normally going to get the same in return. It's that simple.

    Exactly!

Let's do a little social experiment:

To all the cop bashers: Keep in mind that this officer has no idea he's being recorded. All he knows (at first) is that he has some apparently clean-cut kid in front of him, being a pita and spewing some legal jargon at him.... Now, go run a YouTube search on "sovereign citizens" and watch a few of those videos; particularly ones concerning traffic stops. Maybe take a minute to checkout Tim Mcveigh's bio, as well....

Then, come back to this page and watch that video again. Let me know if you think the officer was out of line.

Have they been deemed so by the supreme courts?

After all, you are detaining a person and questioning with no probable cause or suspicion an illegal activity has taken place.

As with the last one posted(open carrying), I still don't like it even if they are within their "rights" to do so.

Sadly this will eventually lead to a far worse outcome than anything seen yet. It seems it is now becoming the "how can I top the last one", it's nothing more than premeditated provocation to see who can be the biggest ******(Summers eve product) while not committing a crime or allowing their rights to be infringed.

The guy probably heard about the checkpoint, grabbed his camera and headed out in hopes of going viral.

    2 Wrong statements.

1: He stated that he could not be "randomly stopped and searched".... Trust me, there nothing "random" about his search.
2: He also said he wasn't required to provide the officer his driver's license.... He was DRIVING A CAR. So yes, he definitely is.

Keep in mind that this is not Johnny Cochran. It's a 21 y/o kid who thinks he knows more about the law than an officer whose likely been enforcing it for decades. All for his ego, and your entertainment purposes. Yeah... he's a real winner.

Yes, they've been challenged and upheld by the US Supreme Court.

Absolutely! And I assure you that's exactly what he did.

What burned me the most was his ridiculously sarcastic "Happy 4th of July" at the end. This kid has no idea that this country is going to hell in a hand-basket BECAUSE of people like him. They weren't put over a knee and properly disciplined; taught right from wrong. I'm not going to turn this into a political debate, but I remember when America was unchallenged by anyone, and we-the-people had a little thing we called common sense. We never considered putting our ignorance on display, for all to see... all to stroke our own ego. In the meantime, I'm sworn to protect and serve his sorry ***.

Excuse me now, while I go vomit :fro:

This guy did nothing wrong. To say otherwise would be a lie IMO. These cops are being unlawful and they know it themselves.

Just pull up to the checkpoint, roll down your window, state whether you have or have not been drinking, and then go about your merry way. Dui checkpoints are lawful and have been unheld. That being said, if you have a problem with that, challenge the law in court or however else you please, but respect the cops. They are just out there doing what they can to help protect people. I am a firm believer in individual rights, but just show the cop your license and move along. No need to be a little punk for no reason.

I remember the very first dui checkpoint I ever worked. We stopped every 4th car. We got 8 drunk drivers in the first 3 hours. That is a serious issue that we would have not discovered unless we did that checkpoint. One of those drivers could have killed any of our citizens.

I've searched a lot of cars and I can tell you, I've never searched a car without probable cause or without consent. Most of the time I get consent to search vehicles by just asking. If someone tells me to stop once I've been given consent to search, I stop. Heck, one time I was given consent to search a house by the homeowner. I couldn't believe she gave me consent. I solved a grand larceny case/prescription pill theft case by finding hundreds of dollars and hundreds of different types of pills that had been stolen. My point. Don't get mad when a cop asks to search your car, they are simply doing their job. If you don't want them to search just tell them no and be polite. You would be amazed at things that are found during searches. Illegal weapons, illegally owned weapons, big time narcotics....things that put everyone in the community at risk.

While I agree a little respect goes along way, there are cops out there that don't show much either be ause of the badge they are wearing. I'm guessing once ccw passes here in some parts of this state there will be a lot of situations like this video shows.

Now grated this dude did go way to far. People, meaning civilians and cops, need to know they're rights.

I think the kid needs to be pistol wipped for being an azz.

What a punk. Wasting time of our public officials to make himself look like a victim on twitter.

This is why I never give cops SH!t and make it a point to tell them I apreciate the job they do because they have to deal with little punks like this.

    I'm pissed for the cop.

First of all, if Josh can refrain from bashing attorneys, I'll refrain from bashing cops.

The US Supreme Court says DUI check lanes do not violate our Constitutional rights. They are not allowed in Michigan though, because our Supreme Court says they violate the Michigan Constitution. (A state can't take away rights but it can grant you MORE rights.)

I think the driver was wrong. DUI check lanes are allowed and the LEO needs to have your window down so he/she can tell if you have been drinking.

I thought the cop was quite unprofessional. He could have simply explained all that. The dog and the search were simply harassment. Even had he found any drugs, they would have not been evidence because he did not have permission to search and the search was not incident to an arrest.

This incident was obviously planned by the driver. It's unfortunate that cops like this are so easy to find that you can drive around with a camera and count on making a YouTube video illustrating an unprofessional cop.

My husband is an attorney who does a lot of criminal defense. He can tell you that there are a lot of highly professional cops. But there are also a few guys who use the badge to bully people. (And cops sometimes need a lawyer.)

Cops defending this guy should, instead, be taking the lead in urging their brother officers to a higher level of professionalism.

Do you really want to be respected only because you're wearing a badge and a gun?
