    Yes, they can do this after they have suspicion... but they can't do it without some sort of reasonable suspicion first. They can't just pull people from cars for no reason and have them dance around looking for signs of intoxication nor can they force you to self-incriminate with a bunch of questions.

    What about hoodies in the summer? Don't think that would be allowed to be called suspicious. I think they'd call the profiling.

    I don't understand your question Tony.

    I also don't understand the willingness to forfeit rights. We've been giving them inches and they've been taking miles for sometime now.

    That was just the kid saying FU to the cop and not being social because you can't make me.

    Say what you want people but the more you tie these cops hands the more bolder our criminals get and the worse society will become. If I new the kid I'd call him an arse and never associate with him.

    Every time we roll down a window, a little piece of America dies people, I see the light now, I may never roll my window down again!!!

    My serious questions is why did the kid get out of the car? Understanding he is now a freedom fighter, why did he wuss out and get out of the car? Hell he should have just drove off or not stopped, wuss

    Because he realized he just encounterd a lunatic. The cop was already trying to open the door, and yes, he wussed :)

    I hate to burst all you freedom fighters bubbles, but local cops(state and county) do not wake up in the morning and say:

    "I wonder how many times I can trample on the Bill of Rights today", now if we are talking Eric Holder I do believe he does this every morning and night. This kid should go after him!!!!!

    I do not believe the cop was a lunatic, just tired of smart *** kids IMO

    But not to catch drunk drivers? I can't speak for the others, but what I'm not understanding is why the rest of you don't understand that unless you have something to hide you'll just roll the window down and talk to the policeman. If you're not doing anything wrong you'll be on your way in no time. If you're not doing anything wrong and you refuse to roll down the window then you must be something like the kid in the video - just a punk trying to push the officers' buttons for kicks.

    Seriously, now that you know that you have a constitutional right to keep your window rolled up, how many of you are going to refuse to roll your window down the next time you come upon a DUI checkpoint?

    Anyone?

    The motivations of the police don't matter. Your rights are your rights. And being "tired of smart *** kids" is certainly no excuse to violate civil rights.

    The kid was most certainly trolling the cops. That much is obvious. The kid is also more than likely a little s***. And yes, if he would have just rolled down his window, I'm sure the cop would have asked him the standard questions and then let him on his merry way.

    But none of that is relevant. The facts are that the kid exercised his rights and the cop decided to teach the kid a lesson because he got pissed/frustrated or it hurt his ego. It is a simple as that. The cop was in the wrong here and it's really not a debate. The cop even said so in the freaking video.

    If it was me, I would have just rolled my window down and did as the cop requested, as long as the cop was respectful. I don't start freedom fighting until I'm provoked by cops. This kid decided to provoke the cops, and got exactly what he was looking for.

    I understand some arguments from both sides. But many of you are making things way to complicated, and clouding up the whole situation. Bottom line is the kid went in trying to cause trouble. The Cop was unaware of the situation. We don't know what was going through the cops mind at the time when he asked the kid to roll his window down. On that same weekend 75 people were shot in Chicago, all from "citizens" shooting each other. The world is messed up and most of these cops protect us regardless of their ego's, attitudes, or beliefs. They run into the mess while you and I run away. They run in to things I couldn't imagine seeing daily. Is the government taking away a lot of our freedoms? yes. We can start a different thread for that though. Stop generalizing, that's what the government does all the time, that's one reason we are losing some of these freedoms.

    All you can do is take this situation and isolate it. The officer may have over reacted in the situation. However I give him the benefit of the doubt in this situation. Facts: Kid went in causing trouble. Cop was unaware of the severity of the situation.
    One line pretty much sums in up: Self preservation (cop) vs. Self promotion (kid) Kids wrong and needs to find more productive things to do.

    So what if the kid had a gun or was drinking and the cop was unable to smell it because the window was rolled up?

    As far as drinking, the cop never even asked the kid if he had been drinking. And if he suspected the kid of trying to hide the fact that he had been drinking, the cop should have stated "If you do not roll down your window, I'm going to have to ask you to pull over to the side and step out of your vehicle in order to perform a sobriety test."

    If you were this Cop, would your own self preservation not run through your mind in this situation? Would you worry about the kid using the gun to harm you?

    Have you ever had a bad day at work? Do you every make mistakes? Has emotion ever clouded your judgement in any decision you've made in life, whether it be fear, anger, or even your ego?

    Kids a prick, no question. THIS cop on this night was too. Might be out of the norm but it is what it is. Once he figured out what the kid was up to, he continued to find excuses to enter his vehicle.

    Essentially, proving the kid right. That's the sad part.

    The punk kid didn't get taught a lesson, he got empowered.:(

    The kid wanted to mess with the cop then got his feelings hurt when the cop wanted to messed with him back. I hope someone has b!t@h slapped that kid by now.

    That's just it. He didn't get his feelings hurt. He got what he expected. That's why the camera was rolling and the cop fell for it hook line and sinker.
