    Sigh...I'm aware that in theory we as citizens have "power" but test that theory a few times and you might be dissapointed with the results.

    Who defines suspicious?

    The fake drug checkpoints and "seatbelt"(with k-9 unit) checkpoints are worse than this video IMO. Hey look the dog alerted on this car. Really it looked like he was just licking his own butt to me but search away. Good times.

    I find people that wear large jackets in public venues to be suspicious. I should be able to detain them without telling them why. All in the name of public safety.

    Does any one question where that "Good cop Bad cop" scenario came from. The never ending videos of cops beating the snot outta citizens and yet there are those of you that blindly support them simply because they are cops amazes me.
    Like any any other occupations there are bad cops just like bad doctors, painters and mechanics, get over it and hope that some egomaniac with a badge and a gun doesn't go postal on the side of your head while he's having a "bad" day.

    I really don't get this. To answer the original question, the kid obviously brought this on himself. He had his camera stashed and rolling which pretty much indicates that he was going to deliberately attempt to push the envelope in this particular situation.

    DUI checkpoints are legal, right? This was a DUI checkpoint, right? I have to agree with PT - the fact that the kid refused to roll his window down would be suspicious to an officer at a DUI checkpoint. If I were driving with alcohol on my breath I would avoid rolling the window down too if I could get away with it, but I would expect the officer to be suspicious of that.

    My opinion is pretty simple, and most of the younger, "in-your-face" generation won't like it but that's okay with me. This situation wouldn't have occurred if the kid had more respect for authority. I'm retired military and a firm believer in respect for authority. In this case the police are the authority. That's what we call them. The "authorities". I've never encountered a single police officer on one of these "power trips", but maybe that's because of my military history as an enlisted man. I was accustomed to having young men and women as division officers and department heads and I was accustomed to orders being orders whether I agreed with them or not, so I have never been anything but respectful to any officers I've encountered.

    I was raised the same way. My Dad was right WAY more often than he was wrong, but he was human and he wasn't always right. There was no questioning his authority, however. Right or wrong you did what you were told - or else.

    I'll be 50 in September and if I get pulled over on the way home today by a 23 year old officer with an attitude, my responses will be "yes Sir or Ma'am" or "no Sir or Ma'am". If I feel that I've been treated unfairly or my rights have been violated there are established avenues to address that. The police are still the authority on the road and I'll treat them with the respect that the uniform deserves. Period.

    It's not about 'respecting' the uniform. It's about exercising your Constitutionally guaranteed rights. The checkpoint itself may be legal but he didn't have to roll his window down all the way and he doesn't have to answer questions. Simple.

    So if I come upon a DUI checkpoint and I don't have to roll my window down or answer any questions, how are the police supposed to determine whether or not I'm under the influence? What's the point in the DUI checkpoint?

    To DETER drunk drivers. Holy hell what are you people not understanding here? You have to have suspicion in order to arrest, detain, or search. It really as simple as that. If he didn't break any traffic laws then he is not subject to any of the aforementioned 3 things.

    In my county, they TELL you when/where the DUI checkpoints are the day BEFORE. They get listed in the paper, and on facebook.

    You don't have to roll your window down all the way. The onus is on the police after that. (and really, if somebody has been drinking enough to be under the influence you can smell it with two inches of window rolled down just as easily as if the window were all the way down.)

    "I know of no law that obliges a driver to answer an officer's questions or perform 'field tests' directed at determining whether the driver has committed the crime of driving under the influence of intoxicants. Reluctance to inform the detained driver that such cooperation is voluntary can only demonstrate the state's willingness to take advantage of those of its citizens who are ignorant of their rights though it must respect the rights of those who know them."

    The police can perform sobriety test and whatnot if they witness a driver breaking traffic laws, like speeding or swerving. If not, you don't have to consent to anything. You can't just be pulled over and searched for the hell of it. George Washington shot redcoats in the face on Christmas eve to prevent this. Your car is treated just like your home (at least in Ohio), they need suspicion or a warrant.

    I work with the police everyday of my life. Local PD, Detectives, Sheriffs, State Highway Patrol...you name it i work with them. Just like in ANY walk of life, there are good and there are bad, plain and simple.

    So you are saying we been MORE legislation to cover idiots that won't follow a reasonable request..... Don't you see that is what it will take if jackwagons like that kid look for every loophole just so he can be "right" ????
