An accident? Dropping your bow from the tree stand because you fell asleep is an accident. What this guy just did is absolutely no different than getting drunk off your behind, getting behind the wheel of a car, and killing someone.

You didn't MEAN to kill someone, but the courts will say you knew what could happen when you drove drunk.

Same thing here. He didnt mean to kill a human being, but he knew there was a possibility it wasn't a bear and should never have fired.

Our law system baffles me daily.

Whats scary is that you hear this sort of thing each year. This "bush shot" seems to happen every season and results in someone getting shot or worse, killed.

These people should not be allowed to hunt. I believe that making everyone take a safety course would be a good idea, though I agree with others who said that this is a common sense issue, not an education issue.

I just don't understand how in the world this guy or anyone who does this expects to make a killing shot on anything just shooting into the brush. This was one of the things my father taught me first and foremost when I started hunting. If you see movement, assume its not what you're after until you've ID'd the "critter". Then, if it is something you're going to take, and only then, you can get your gun into position and WAIT for a good, clean, ethical shot to take the animal down as quickly as possible. Something you can't do shooting into the brush.

    Sad to hear this.

I completely agree what he did was negligent and well beyond stupid, but during gun season on State Parks isn't it required to wear orange when walking about the land and while sitting in the stand?

Simple things that they implement to ensure our safety. Sad, sad story.

I agree with you 2xlung5h0t, he should have been wearing blaze orange. But in this case, I feel the negligence still falls on the shooter and none on the victim.

It's like a burglar walking through your front door because you didn't lock it at night...or a woman getting raped "because she had on a tight skirt". The burglar and the rapist are both 100% at fault...their victims are not at fault.

At least thats how I see it...the guy with the gun has elevated responsibilities...he has a gun =)

Sad story and my prayers go out to the Family. This is why I won't hunt with a decoy you never know what yahoo is out there, that will take a shot at anything that looks remotely like an animal. There was an incident here in FL where a Father shot at what he though was a Hog at like 300 yards and Killed His son, very tragic.

I'm a former U.S. Marine myself and I can't even begin to express how sad this makes me. In my opinion his person should be charged with reckless homicide. I don't know any responsible hunter that has mistaken any human for an animal.

I can not for the life of me understand how anyone can "brush" shoot at anything. It's completely unacceptable. Identify your target before killing it, period. I hate these storys. I really feel for the family of the deceased.

And this is why I tell my wife to wear Orange when she walks the dogs. We are even thinking of getting the dogs orange collars as well.

I'm glad to see so many agree with me. If you kill someone, shooting blindly into a bush, that is NOT an accident. Manslaughter at best
