If your job and livelihood hinged upon a test like this and there was a set of procedures that both you and your employer agreed to folllow, infact you both signed a contact to the effect. Shouldn't you both live up to the agreement ? If that happened from the start the we couldn't even be discussing the incident
I agree both sides should live up the agreement, but I'm confused with the "we couldn't even be discussing the incident" part. Not just because of the poor grammar, but because the failed procedure isn't what resulted in the failed test. It just left Braun an out.
Veto, per the contract: results aren't allowed to be made public until all the appeals are exhausted. In other words Braun mostly likely is not the first player to win and appeal. Per the CBA, public results are expressly prohibited by both sides unless an appeal doesn't result in an overturning of the original findings.
Lets pretend you're appealing a ruling you were on trial for. You have two ways to overturn the ruling..... #1 will prove you 100% innocent, but you have a 20% chance of winning the appeal with that method. #2 will leave doubts in people's minds, but you have a 75% chance of winning with that method. Which do you do?
I am not a baseball fan by any means, the only things I hear about the sport are on basic news shows or over the radio. What gets me is that all these great players continue to get caught with performance enhancing drugs. Come on guys!!! Wake up and smell the coffee; If you are a better than average player you WILL get tested on a regular basis. What is so damn hard about that to understand. When I wrestled at Purdue I was a .500 wrestler and I even got tested 3 to 4 times a year. Do the benefits really out weigh the risks? I do not feel one bit sorry for a single one of them and they should be stripped of all records, awards, and money that they earned while taking the drugs. Sorry for coming off as harsh on the topic, but, to me, its just ridiculous that these players even take the drugs when they surely don't need them.
He got off because of technicality, not because he didn't fail his test. He actually failed his second test too. I was a huge fan of this guy and was hoping It would get reversed for reasons being he didn't take anything. It got reversed alright but for the wrong reasons. He'll never be looked at the same by many. MLB will appeal this I'm sure.
Good thing he's not a mean looking black guy that broke a lot of records because the government would be after him then.
He failed one test. The sample was taken by a part time collector, who took it home and left it sit on his desk for 2 days before sending it in. ESPN Legal Analyst Lester Munson reported on Mike and Mike this morning that Braun offered a DNA sample to prove that the urine wasn't his. It would have been a conclusive test, but the MLB rejected it. What other choice did he have but to have it turned over on a technicality?
Yeah I get it. I'm not saying he shouldn't be suspended. There was a loophole and he got off on a technicality. Plain and simple. I dont' see how this in anyway clears his name. He failed the test period. Now he doesn't have to serve the suspension because of some bonehead Fed Ex dude. So yes... .everyone lived up to their agreement as they should and Braun gets to play on opening day without suspension. IMO does nothing for fact that he was taking PED's. And I'm pretty sure I'm not alone on that side of the fence.
