It is crazy but, even in our justice system, anyone can be accused, and even charged, with a crime if there is a willing prosecuter and plausible enough circumstantial evidence. Even without enough circumstantial evidence a person can be charged and brought to trial but the trial is where the rubber should hit the road. Here in the US people are charged all the time but charges are dropped before trial because they either haven't gathered enough evidence to win or other evidence has exonerated the charged.
