Florida has permanency thresholds on liability claims - this means that unless your medical records provide some % of permanant disability to you based on your injuries you cannot make a claim / recovery from that at fault party. What this does 1. Everyone finds a Dr that will give them 2% 3% 4% disability rating 2. Increased settlements because jury's for the most part are stupid and read 5% disability and reward $$$ 3. to balance loss ratios insurance companies have to increase premiums 4. Florida kind of allows unrealistic timed demands on settlement, example you'll get 750 page demand packet in the mail, snail mail only. It took a week to get to you, the demand letter states something along the lines of ..." unless we receive a policy limits tender within 5 days of the date on this letter we will sue, call your mom, buy a bad faith claim etc." 5. CAT's will devastate a decent loss ratio, so if you're fighting all the crap above, then catch a billion on a CAT year after year you're screwed It is shocking how bad Florida is set up for this stuff based on being a semi based state.
