No one forced the parents to put their child into little league. Suing the league for the kid getting hit with a ball off a bat that may have been against the rules is like suing a state for the actions of an individual in that state. Guilt by loose association should not stand up in court.
You are absolutely right. But since they did sign their kids up it was the duty of the umpires to check the bats. I think they will win the case but $1 million is a pretty crazy suit. They should only be paid for medical bills since there are assumed risks in baseball.
First off, if the other team was using an illegal or modified bat, shame on them. Cheating in little league is disgusting. The umpire is responsible for inspecting every bat prior to the game, but it would be easy for a team to hide a bat during the inspection, so I don't see how you could hold the umpire(including Little League) responsible. My daughter is a softball pitcher, and they sell face masks for the girls to wear until their reaction time speeds up to be able to react in time. The parents are just as responsible for not purchasing protective equipment that would have protected their son. That was their choice.
Sometimes lawsuits are about a statement or a legacy and the monetary amount is just part of the policy.
Sucks for the kid who got hit that is for sure but this happens with or without an illegal bat. Now that there is some chance that something was illegal it is time to sue. Had they not heard of a bat that may have been illegal would they still have tried to sue?? I have to agree that it is part of the game being hit that is...now cheating in little league that is pretty sad.
