Don't be surprised when he does. Re. this bypassing congress thing, do the democrats not realize the tables will one day change and the republican president will be the one bypassing congress? Personally, I want both to honor the constitution and work within the self limiting structure. Another thing, I am sick to death of hearing how we 'must realize Obama won the election'. The only appropriate response is, yes he did, and so did the House of Representatives become more conservative. I seem to remember a day when the Senate was the more conservative and deliberative body. What happened?

The story may be old; but this is not "old news". SoS Kerry signed the treaty in 2013 (sparing Hillary from having to sign for and then defend in 2016.) At the time, the Senate did not have the votes to ratify it (red state Dems likely not looking forward to getting their asses handed to them in the 2014 election if they voted for it.) The problem is now that it is signed, the Senate can bring it up for ratification at any time. So, if the Dems maintain a veto-proof majority after 2014, it is almost guaranteed they will bring it up for a vote again, and if that's the case it has a very good chance of passing. International treaty approvals are under the sole purveyance of the Senate - the House has no authority to stop it. Elections have consequences.
can/will it be fought out in the courts? Sure. I'll file the lawsuit myself. However, by the time it gets through the courts (and guess who has been packing in federal judge appointments for the past 6 and next 2 years???) God only knows what havoc will be wrought. And since when has the Constitution mattered to this pack of assclowns? They never stop. They push, push, and push. Injunctions are temporary setbacks. They just reload their coffers and refile their appeals in another jurisdiction.
