"In Indiana it has become legal to shoot a police officer if they unlawfully enter one's home. The controversial gun law is the first of its kind in the United States and has many law enforcement officials unhappy with the recent ruling. The National Rifle Association was a strong supporter of the so-called Castle Doctrine recently passed in Indiana, but could we expect to see an increase in these types of incidents?
Interesting. Gotta think about it more before i post. Im all for Castle law, but with Police officers it may be different at times.
Think about someone dressed as a police officer coming into your home. You have no way of knowing if they are intruders and if they are entering illegally, then we must assume they are up to no good. Sent from my DROIDX using Tapatalk 2
Soooo... Police get a tip a little girl is getting harmed in a home, possibly about to be killed. No time for a warrant, they enter in looking for the girl and get killed by homeowner. No little girl was found....and no charges get filed. Very CSI i know, but Police get payed by the people to protect and serve.... Very grey area.
The word "unlawful" is so vague it is scary. And the flip side to this is not Cops getting shot, it will be homeowners that will be killed if they think they can just start shooting at the people who are there trying to protect and serve them every day.
When you read stories like this...common sense got to come into play....but it also could play out like this. Knock Knock knock! Who is it? The Police. If someone is dressed as a fake cop and you shoot them, why would you need a law passed to be able to shoot a cop, because they are not a cop?
There's Germ with that pesky logic again. This is the Internet - there's no place for logic here! Although to play devil's advocate, it seems to be that the law is more a protection for the people from the illegal activities of police. Should a police officer being doing something illegal, you would now have the right to legally defend yourself against them. The problem is, your average Joe isn't going to have the slightest clue in the world about the legalities of most police actions. And we all know what happens when a citizen has a gun in their hand and the police are present. 9 times out of 10 I'm betting someone is going to die and the situation isn't going to end well.
At the time of the shooting you do not know they are fake. This law just gives home owners the right to protect their property without fear of prosecution. Which they already have so its basically a law on top of a law that already exists. If a cop enters your property without a warrant, he is breaking the law and you as the home owner do not know the premise of the unlawful entry. Imo, the home owner already has this right. Apparently the law has been overstepping their authority in indiana to make a law like this. Sent from my DROIDX using Tapatalk 2
Well I think its a good law. For most law abiding citizens "the amateur's" post is exactly what should be done. When a cop shows up call and if the dispatcher says yes he is supposed to be there or his cruiser is outside that should ease the tension. And cops should know that too. Now for people who dont obey the law and do illegal thing's as in convicted felon's, drug dealer's, gang members. When cops go to those residences they should be fully prepared and knowing a gun fight could occur and they should be wearing a vest with back up. It will keep crooked cops from getting away with a lot of **** to. Im all for it.
I have nothing against the state of IN, but sure am glad I don't live/work there. (No offense Crick!)
This law came from a series of illegal entries by law enforcement in the Indy area. They were basically just kicking in doors of unsuspecting innocent people without warrants thinking they were drug dealer houses. This went on a few years back when I lived there for a short time. One home owner was shot by the police. The guy was simply trying to protect his family as he thought it was just a bunch of thugs kicking in his door.
Great example. This is just a law to protect a home owner incase one does accidentally shoot an officer in an instance like this. This does not give you the right to just walk around and wack cops. Probably a poor choice of words by the O.P.
