    For whatever reason they are not going to pursue it today. Doesn't matter why, just good that they're not.

    There was some militia guy that was talking to the press after they announced no gun control measures would be heard, they yanked the audio half way through it. He wasn't holding back with his words

    Of course they don't wanna hear any of the "gun nuts" talk, might actually have some valid points.

    It's all a bit crazy. Luckily my bro in law got me a Ruger BX-25 the other day. They are rare now. Any kind of high cap mags. I can't even find 22 shells. Luckily I hardly ever have less than 2k rounds on hand.

    The government will do what they do every time. Make more laws and make getting guns a little more trouble with stricter back ground checks. That won't change anything as most of the shootings are done with stolen guns.

    Even if they ban guns there will still be guns out there. The people going to commit crime with guns will find them no matter what or make them. They need to quit blaming the guns. If guns kill people, spoons make people fat. If guns kill people then playboy gives wrists carpal tunnel.

    Instead of gun free schools make it to where every teacher and staff carry a firearm at all times. Make sure they are trained to use it also. That would cut the school shootings down to near nothing I bet.

    If they want to ban stuff how bout banning Cigs and Alcohol. Those things kill more people in a year than gun related violence.

    The whole subject makes my blood boil.

    Madigan filed her challenge today to the federal courts ruling IL's ban on concealed carry was unconstitutional. Looks like it may end up in the hands of the Supreme Courts one way or another.

    I hate Chicago

    If I am not mistaken the court was comprised of 3 judges and the vote was 2-1.

    Well the way this one works, it will go to all 10 of the judges if they choose to allow it to be reheard. From the sounds of it we have the numbers 6-4 in our favor. A few of them were nominated by Reagan a couple from GHB and a couple from GWB. Others are from Clinton and Obama.

    I'm not real familiar on what will happen with this whole process, just been following it at illinoiscarry.com.

    There was a lot of debate whether she would file or not due to possibly jeopardizing her governor run. Yet, it was totally expected just the same. Good thing is that the 180 day to pass conceal carry is still ticking down for now.

    That is correct, this time it will be in the hands of all 10, or they could deny her request and tell her to get a bill agreed on while you still have time. Either way this will get taken to the Supreme Court, just depends on which side takes it there. It will set a precedent one way or the other for all the states.

    Well guys, consider yourselves lucky. NY votes tonight on our bill, they are cramming it in without the 3 day review process because I think Cuomo wants his name all over the first major gun legislation before Obama. I really don't think it's going to be easy to pass much on the federal level, but there will be a handful of states that might follow NY if this passes. Hopefully IL doesn't catch some momentum if/when this passes in NY, because assuming you guys pass concealed carry the laws will then be a lot less restrictive there than here in NY.

    I should know more about my potential work relocation to IL next week and if this goes through I might take a relocation offer that I normally wouldn't have considered.

    A quick summary for those of you that don't want to read the whole thing.........

    • Further restrict assault weapons to define them by a single feature, such as a pistol grip. Current law requires two features. (We already have the old AWB laws in place, this makes it basically impossible to have an AR that is AWB compliant)
    • Make the unsafe storage of assault weapons a misdemeanor.
    • Mandate a police registry of assault weapons.
    • Establish a state registry for all private sales, with a background check done through a licensed dealer for a fee, excluding sales to immediate relatives.
    • Require a therapist who believes a mental health patient made a credible threat to use a gun illegally to report the threat to a mental health director who would then have to report serious threats to the state Department of Criminal Justice Services. A patient's gun could be taken from him or her.
    • Ban the Internet sale of assault weapons.
    • Restrict ammunition magazines to seven bullets, from the current national standard of 10. There is a lot of fuzzy area around this one, where it appears a preban (pre 94') magazine may still be legal, but anything between 94' and 2013 isn't really clear. Will need to wait and see an interpretation of this one in more detail. Also not sure if this applies to all guns or just semi autos or assault weapons. It does specifically say an owner caught at home with eight or more bullets in a magazine could face a misdemeanor charge.
    • Require that stolen guns be reported within 24 hours. Otherwise, the owner would face a possible misdemeanor.
    • Increase sentences for gun crimes including for taking a gun on school property. The "Webster provision" would increase penalties for shooting first responders. Two firefighters were killed when shot by a person who set a fire in the western New York town of Webster last month. The crime would be punishable by life in prison without parole.
    • Limit the state records law to protect handgun owners from being identified publicly. The provision would allow a handgun permit holder a means to maintain privacy under the Freedom of Information law.
    • Require pistol permit holders or those who will be registered as owners of assault rifles to be recertifies at least every five years to make sure they are still legally able to own the guns.

    FYI, they just passed it 43-18. Keep in mind republicans own the majority as well. I'm literally sick to my stomach right now and hope this doesn't set the tone for the rest of the country. I'm embarassed and ashamed to be a resident of this state right now.

    That sucks, oddly enough hopefully IL can help you out. The ruling that was made to override IL's ban on concealed carry will probably end up in the Supreme Court, whose side takes it there remains to be seen. Whatever they rule is going to set a precedent for other states. Hopefully it's a good precedent. But it sounds like whether its a ruling on us or a clarification on one of their former rulings it will happen.

    I couldn't imagine the choice of NY to IL. Really don't know how this state is going to survive. They can only tax us so much before the people just can't afford it. We'll be the Cuba of the U.S. shortly.

    Here's an interesting read on Rahm Emanuel's hand picked superintendent of the CPD Garry Mcarthy. Looks like he was a winner while in NY. He's the one that said if IL passes concealed carry his officers will end up shooting people with cell phones and flashlights, because when someone turns around a cop has to either shoot or be shot.

    I'm not so certain that the Illinois Concealed Carry case will end up in the Supreme Court, unless of course the NRA loses in a re-hearing of the full 7th Circuit, and the NRA appeals it there. I'm pretty sure Madiagan is hearing from the NY and CA liberals, who fear that if the logic behind the 7th Circuit opinion is applied by the US Sup. Ct., then all of the ridiculous, restrictive, unproductive laws on the books in "May Issue" states will be thrown out. FYI, Judge Posner, who wrote the majority opinion, is one of the foremost legal scholars on any Circuit Court, so they should be afraid.

    I would be surprised if this didn't end up in the Supreme Court. By filing for a hearing en banc she has already set the stones in motion. A request by Gura has already been sent to the Supreme Court to have it heard there.

    Sometime around or before Feb. 4th is when we'll know what the 7th will do. And while it is stalled in the wrenchwork of the legal system they will keep imposing as many bans and gun laws as they possibly can. Another thing to keep in mind, while people say Posner rules by word of the law and not so much for or by public opinion, the original ruling was put it in days before Newtown happened. Will that have any bearing on their decision to rehear it?
