House help

    We just moved into our first home last week and with this crazy snow melt found out that our basement leaks pretty badly.

    The sellers didn't disclose this problem and said they were unaware of any water damage. They were the first owners of this house. We had a full inspection done but since the sellers had all their crap in the home it wasn't visible. They had big cabinets in each corner that there is any sign of damage. They even cut 2 foot of drywall off in a spot in the garage and an 8 foot section in the family room. They painted the concrete in there but had a big bookcase in front of it.

    Sounds like they lied on the disclosure. If you paid for an inspection, thats the guy I'd have an issue with. He's paid to know what to look for. Sorry man, leaking basements suck.

    I would call your agent. In our buy/sell agreement we had it written to where any undisclosed damages/issues/etc.. would be taken care of by the seller in full for 1 year from the date of purchase. We got a brand new dishwasher just after moving in because of that.

    I would be going over paper work and making some phone calls. Sorry you have to deal with that man!

    I'll definitely be making some calls. I'm glad it happened as soon as it did so I can try to make an argument. We will see.

    While I agree with calling the agent, I wouldn't hold my breath...

    BC , sounds like you had a home warranty which is paid for by the seller..

    Dan... Worst case scenario, drain tile is hard work but relatively cheap.... Did we not talk about this before though?

    Did you have your own realtor or did you use theirs? Did you get the usual one year warranty that is included through the big realtors? If you had your own, contact that realtor. If not, give their realtor a chance to make it right. After that, contact the Iowa State Real Estate Commission for arbitration. Finally, if all else fails, call a lawyer. Sucks when it happens, but it does happen.

    No warranty. I had my own agent. My biggest issue is that they said they had no knowledge of water damage. Had they said it leaks with a hard rain or fast melt it would be totally different.

    This all varies by state.. Dan, I thought we talked about you doing the drain tile?

    Right.... Bathroom.... It would be a great time to do it all... All the same material. Ish.... LOTS of work though... But pretty cheap to do...

    This is most likely a combination of grade and footing drainage problems. Where is the water coming in?

    My thing is that if water is getting in shouldn't I do work outside the house to get water drainage away from those spots? I might just be paranoid but it's my first house amd I paid more than I wanted so I could get a sound house.

    In Illinois if you lied on the residential real property disclosure report there would be consequences.

    Am I reading it correctly in that they cut out the drywall in the areas of leakage (likely due to mold) but still claim they had no knowledge of a leak?

    If so you'd definitely have a case against them if they absolutely refuse... but it'd likely be an expensive/timely endeavor to pursue it in court.
