Does the NFL have the right to enforce marijuana usage policies for players in CO?

If NFL players living in Colorado want to use marijuana legally, should the NFL be allowed to enforce substance abuse policies on those players if they come up "dirty" during substance abuse testing? I for one say, NO. If it is legal in Colorado, it is legal, period.

It's still illegal by federal standards.

Yes they do. Just because it's legal to smoke, there's still ramifications. If a company decides to drug test, and they have a documented policy against drug use, it's the company's decision. Just like Federal employees (military, US Marshals, etc), they can't smoke it if they live in states which allows it. States allowing drug use just means they won't prosecute. If the Feds still want to, they can.

It's no different than flying to another country such as Jamaica, Netherlands, etc where drug use is legal and doing something there. Then, you fly home, get popped on a random drug test and get fired. It was legal, right?

Professional football contracts don't allow drug use period weed or otherwise..

Like any business NFL teams owners have the right to just say no to people on their payroll!

I see it much differently Tiny. If smoking marijuana in CO is legal, then what the heck? It is not a performance enhancing drug so the NFL should be hands off when it comes to players from CO who smoke weed. That simple.

I'm with you there, in that states have rights as well. But, in your case, the employer has the right to say what they can, or won't, allow. Employer's rights trump so long as they don't discriminate based upon race, age, gender, religion, sex bias, etc.

If the NFL wants to go all federal, then maybe they should pay taxes. If not, they need to get a grip.

The NFL owners don't pay taxes?

    Are you sure about that?

If I hire you, and have a written policy against drug use (regardless of legality of weed), then you don't have a leg to stand on. You agreed to the rules of employment, and by breaking them, you agree that you can be fired for said reason.

I agree. That being said, that agreement needs to be changed based on the recent legality of marijuana in CO.

Many hospitals don't allow people to smoke cigarettes, even though they're legal. To me, that seems wrong, but I believe it was deemed legal.

There are employee dress codes, appearance codes (shaving beard), behavior codes, etc. I see no difference. Has nothing to do with legality State, Fed or otherwise.

My MIL worked for a Private College, it was in her contract that she couldn't drink, or gamble.

Once again, their house their rules.
Hey its not liked they don't have a choice.
Ricky Williams liked it so much he retired.

And for the record, I'm not against drug use.
    I personally don't and don't care to.
But if somebody wants to I say go for it, but
don't exexpect any sympathy or any quarter should your actions be detrimental to your health.

The Only place in the world drugs are 100% Legal is Portugal, Anywhere is is illegal on a federal level.

If anything allowing athletes in CO to consume THC would be a benefit to the rest of the teams around the US, Have you ever tried to hit or throw a ball while high,? I couldn't imagine taking a huge hit in Hockey while baked out of my mind lol.

Negative. If you and I sign a contract, yet one of us breaks it, the contract still trumps.

No way should they allow mary jane in football. Football is about being healthy. Brain trauma is nothing compared to a joint.
