Dealing with tresspassers....at night

    Idiots like that is what makes all coon hunters look bad but when you put competition in any sport that's what brings out the a holes

    I would post signs alongside the no trespassing and especially along the roadsides - "Coyote Eradication Zone - Beware of Traps!" - or something like that...and if your coyote season is open then I would actually have a bunch of traps out...believe me they will stay out of there, especially after a couple dogs get caught.

    BTW - is it legal for them to be 'packing' if they have no valid hunting license for an open season - especially after dark with lights this time of year in michigan you can not have any sort of centerfire firearm besides a shotgun for predators(only with shot smaller than 'Buck')along with spotlights.

    I would roll with some kind of intimidating sign, like the coyote one mentioned above. I wouldnt actually go as far as booby trapping the place, though.

    Something mentioning that the property is under surveillance, being monitored or set up for trapping would keep me out if I was of the tresspassing nature.

    Confrontation useually is a bad idear but I'd more likely shot thier truck up or at least thier tires if I had the chance.

    Dogs getting shot around here happens more frequently than it should...and I don't mean that I would booby trap the area - I actually trap fox and yotes so the traps are there...along with my brothers sets as well. I released 4 dogs last year including one of my own and 3X others got out on thier own - another one of mine and one other was a lab I released earlier(I had cams nearby that took pics so...).

    A gun and a video cam and asking them to leave should make them move faster.

    Um, only if they are on their property, public land or have permission to be on the land. If they are in your property illegally, it's game on for screwing up any part of their hunt you want. Trespassing is trespassing here just like anywhere else in the country.

    I would have a hard time not loosing it on the guys. Them having guns or not. Thing is, they won't shoot you. If they were going to they would have when you confronted them. It's your property. I would probably peppered the tree tops with some number 7 shot. It would have at least gotten their attention.

    Step out the door with a 12 gage and fire off 2 shots in the air and tell them the next 2 will be in their direction.

    I'm thinking that assault with a deadly weapon is a felony there just as it is here. Threatening them with a gun would be out of the question.

    If the cops won't help you, there isn't much you can do but wait them out and start organizing a resistance to having them back in town again.

    The castle doctrine only applies to your home and the curtilage. And it only removes the duty to retreat. It doesn't allow you to shoot trespassers who are not posing a threat of harm to you or your family.

    Not in my state. I know the scope varies in states that have this type of law, but in KY it applies to any place the person has a right to be. That would include their farm or even car. If they feel a threat to life or limb force can be used. Castle/Stand your ground is certainly a provision land owners should be familiar if it applies in their state. But most importantly, never shoot an armed trespasser in the back ;)

    I think you are going to have to get the 200 citizens together and pitch a fit with the town, county and local department of natural resources!! Get a petition together to have locals sign that states you don't want this crap going on!

    You're correct. The common law duty to retreat outside the home has been removed by statute in Michigan and apparently also in Kentucky.

    The law is somewhat misunderstood and the application of the term "stand your ground" increases that misunderstanding I believe. What the law does is enable you to act in self-defense if you are threatened with death or serious injury without the common law "duty to retreat," in other words, an obligation to run away, if possible. The law also bars suits for wrongful death by relatives if it is determined that you acted in self-defense.

    That said, I don't believe you would be free of legal entanglement if you shot a trespasser, even if that trespasser, being a hunter, was armed. According to my husband, you don't have to prove you acted in self-defense, it's up to the prosecution to prove you did not. But that might be easier than you think.

    Mr. Zimmerman down in Florida is living proof of the fact that you don't necessarily claim self-defense and walk away. Last winter in our town, a man shot and killed someone who had broken into his home. Even the traditional castle doctrine would have applied I would think. But the prosecutor kept the guy sweating for three weeks before deciding that the shooting was justified and there would be no charges.

    I guess it bothers me that people can so easily talk of shooting someone merely for trespassing as though life really should be that cheap. I know internet macho talk is pretty common and guys probably really wouldn't do some of the things they talk about. But it bothers me nonetheless.

    No signs of any coon hunters after Thursday evening. I'm sure they found some new places to trespass ;)
