As was on another thread, propane in my area is at $5/gallon. This summer I contracted 750 gallons at $1.36/gallon. I have 405 gallons left on my contract so we'll make it through winter just fine with the contract pricing. Tank is at 40%, so I called today inquiring about a fill and was told to wait until the tank is down to about 20% and call again and they would only delivery 100 gallons at a time. Then the kicker.... She said they are adding $0.30 to everyone's contract pricing to cover the increased cost of delivery to their facility. I checked my contract and the only language anywhere close to allowing them to do this states..." Contract pricing is based on company established minimum delivery standards." Is this their out? I'm not overly upset because we're much better off than some without a contract, but next time they fill, if I were to tell them, "due to the increased cause of unleaded and my cost to get to work, I'm decreasing my payment by $0.30 per gallon. Are they in the right here?
Waste management pulled something like this on me. I signed a 2 year contract to hold my price. So every month after that the bill was rising about a dollar a month . Turns out they weren't raising the dumpster cost but rather the environmental fee associated with it, she pointed out that they were authorized under the contract to raise this as they see fit. I'd say they have the right to according to that clause but who knows. In the grand scheme $30 on a tank isn't worth getting worked up over (even though its just the principle of the matter that really grinds your gears in these situations)...
No. They do not contractually have that right from that clause. Not to say it isn't some place else in the contract, however it doesn't stem from that sentence. All that says is that you can not take delivery of less then their minimum delivery amount. For example If their established minimum is 100 gallons, you can not order 50 at your contracted price. If you can email me a copy of the contract I will discern were if any loop holes are written that would allow them to change the contractually agreed upon price.
