That wasn't even a huge point in the book...sorry I don't think that issue caused book sales to increase or decreae. Also lying about killing deer isn't quite the same.
I'm pretty sure that evidence was presented in the case. The dramatic rise in sales if there were some, which I'm sure there were coinciding with his interview. The jury was undecided. Most sided with defamation but 2 didnt. The deer was an example. If you think people are incapable on lying about these kinds of things, then I'm going to tell you, you're flat out wrong.
There must have been some evidence indicating Kyle had lied for Ventura to have won't the suit right?
Well its kinda like he couldn't prove he did it. That would be my understanding of the situation and lawsuit. I don't know the difference between slander libel and defamation though
1) civil suits are decided on the basis of a preponderance of evidence; meaning more likely than not (not beyond a reasonable doubt like a criminal case.) In other words, 51%. So if you have a jury of 7, four agree with the plaintiff (JV) and 3 agree w/ the respondent (Chris Kyle's estate); then the plaintiff prevails. In this particular case, it sounds like JV had a couple more witnesses support his side than the Kyle Estate had supporting theirs. In this specific case, 8/10 jurors sided with JV. 2) Jesse Ventura was not technically a SEAL. He was a member of the Navy's Underwater Demolition Teams (UDT) , which were pre-cursers to the SEAL teams. Despite serving from 69-75, he never served in Vietnam. (Does not necessarily mean he never saw combat. Lots of classified missions going on all over S/E Asia during that time period.) 3) Slander is spoken word, libel is written. Defamation is basically character assassination without basis in fact which results in damage in the form of a tangible loss.
I just wonder what he thought he would gain from something like this. Granted it was started before Kyle got killed but how it played out now looks alot worse then people thinking he was bad mouthing the SEALS and got knocked on his butt. As far as the sales go I doubt they went up very much when Ventura's name got mentioned. Probably had more to do with the death of Chris. Not sure that time frame is real close but like already mentioned it was kind of a small part in the book really. Sent from my SM-G900R4 using Tapatalk
They were 13 months apart between interview and death, so if there was a significant increase, in that month of the interview it could be attributed to Jesse Ventura. We'll never truly know as it could've been simple media exposure that would've caused the rise, one could also argue that even without a rise in sales, it was his defamation of Jesse Ventura that kept his sales going the way they were.
The lawyers representing the Kyles are idiots, why would you agree to modify the jury verdict by allowing the non unanimous verdict in the home state of a guy that was elected to high office? Never ever take chances with a jury.
only part of the settlement will be paid by insurance, about 500k. The rest is coming out of his estate and from his widow. I hope Ventura can live off that money for the rest of his life, because he'll never get another job.
Too much petty BS in this world, not enough unity and outdoor adventures. I think I was born in the wrong century...
You guys do realize that Chris could have made the story up right? As for not getting a job, I'm pretty sure he'll be able to get one.
If you read Chris's book you would see that it doesn't need extra "entertainment" in it. It was like two paragraphs. No reason to make the story up and put it in his book. Jesse is an idiot and I fully believe the event took place and if Chris was alive to defend himself he would have won. Either way the guy was a hero and his widow doesn't deserve this. Not even the money but the trial and everything right after she lost her husband... I can't imagine. As for Jesse work status, I believe he has his own TV show...
Again you guys are refusing to acknowledge the possibility that people lie for various reasons. Im being the minority on this and im backing out before I keep slamming this, but you guys are basically slamming Jesse because he went after a fallen hero's wife and estate, which probably wasn't the most PR or moral thing to do. But, we don't know if it was a lie or not. Jesse deserves justice if what Chris wrote was Not true. Not quite sure how getting $1.5M when he is already rich and getting bad PR for this trial is justice on his end, but that's what he wanted. And that's what he got.
Whether the story is true or not I don't think a reasonable and moral person would sue a widow. I also think the press time from this could be what Ventura wanted just as much as the money. Chris Kyle's widow will be fine, I'm sure book sales will continue and she will make enough money to recover from this.
Well not really, you simply stated that you didn't think he lied and the book didn't need more entertainment. That doesn't stop someone from lying. I didn't follow the trial until you brought it up, but why do you think Chris would have won if he were alive? I would think suing a fallen heros wife would sway the jury toward chris more than chris himself. Basically his evidence was testimony from friends right?
No with allowing the verdict to be a simple majority the case was lost, the publisher of the book has deeper pockets and the mistrial on a hung jury would have served them better. They gambled and lost vs taking the away the home court advantage that Jesse had.
