I could see why LL might be held somewhat responsible here, but why the bat manufacturer and sporting goods chain?
Same as when someone gets shot with a gun. They have sued the manufacturer and the gun store who sold it many times until the senate voted to protect the manufacturers in the early 2000's.
I say this, I ask the question about what would you do in this situation to others. I honestly believe none of us really know. This is what I do know, I would be extremely sad and angry this happen to my child. I can say the line "This was just a freak accident" would not calm me or help me accepted what happen. I am pretty sure it would just make me angry. As a parent when your children reaches a certain age we start to see their potential and what kind of adult they may become. In all honesty if that was all wiped out like this young man, it would ruin me.
Tfox, I have a question for you. I know your daughter is involved in cheerleading. What if your daughter's school signs a male cheerleader out of highschool who is a "hot prospect". Lets imagine that the male cheerleader was never classically trained as a cheerleader but was one heck of an athlete. And to add to it, he only cheered for one year before college. Well the guy gets into college and the coaches just love him because he is so athletic and because he picks up on the basic skills necessary to keep his fellow cheerleaders safe. In fact, all three of his college coaches feel confident that he is safe even though his basic skills are not up to par with his fellow cheerleaders. Skip forward to the first college football game of the year where the entire cheerleading squad is participating. On the first male supported cheer move, the new male cheerleader tries to execute a move he just learned a couple of months earlier and fails miserably, thereby causing a catastrophic accident that leaves a female cheerleader paralyzed. Is there anyone to blame? Should the coaches be sued? The school? The USA cheerleading association for not providing neck braces to every cheerleader? The shoe company? The rubber track company who made the track to "springy" and caused the male cheerleader to every so slightly waiver before executing the fatal move? WHERE DOES IT END?
Who wouldn't be angry at what happened? Does anger give you the reason to make someone responsible? You know the risks when you let your kids play, right? Do you get angry at God? I mean, he allowed this to happen afterall. Don't go after the store owner that sold the bat. That is nonsense. Don't go after that bat maker. They are just making bats that are for legal use. You signed your kid up to play because your son wanted to. You both knew the risks. What will come from this is each kid will have to wear a full face mask and catchers gear to take the field. We will lower the level of play and give each kid a trophy at the end of the year.
Yes when it happens to you how do any of us know how we would react or what we would do? Talk is cheap, I never said I would sue anyone, I believe I stated I have no idea how I would react. Yes I would be angry at God. I am not going to judge these people, because I am not in their shoes.

So the kids injury was a "one in a millisecond" type accident that was not dependent on the "hot bats" that people are talking about in reference to this case? From the sounds of it, any ball hit off any bat would have caused that death.
I have another one for you. I used to train with a well known heavyweight boxer. Sometimes we would spar and he would really slow it down so as not to put me in the hospital. Well sometimes he would get tired and I would not stop trying to hit him for all I had because that is how you have to train in order to be ready for a fight. What if he decided he had enough and engaged me with full vigor and broke every darn bone in my face so that I could have no longer worked various jobs and such? I signed up for the fighting, I signed up for all of it. If that would have happened then I would have dealt with it. Who would I have sued....my fight coach for putting me in the ring with someone who could have ended my existence? The heavyweight boxer himself? The UFC for giving me the desire to fight MMA? The company whose headgear I wore?
Your kidding me right? We now have pitchers wearing chest protectors? How did I know this was or probably going to be the result? We should probably let each kids mother go out on the field with them and hold their hands.

My daughter wears a face mask in the field and her helmet has one. Being safe is not being tough, it's being smart.
There is nothing wrong with being safe while playing sports. I'd encourage every child's parents to ensure their loved one's safety. My son wore head gear, chest protector, arm guards, cup and shin guards all throughout Tai Kwon Do. I wouldn't let him participate any other way. I made him practice with the equipment on too. That way when he sparred, it was like every other time he put the uniform on.
