I've been thinking about the Boulder shooter quite a bit, I wonder if his motive is based partially on the airstrikes that were ordered in Syria late last month, The guy is from Syria, he has obvious mental issues. His home country starts getting bombed and a few weeks later he buys a gun and kills civilians? I don't know, I haven't heard anyone else mention it. Just a hunch.
When one gets their news from WaPo, they get fake news. I don't care where you actually got that from (and even some conservative sites similarly parroted these false talking points) that was originally taken from the easily dismantled false characterizations in the WaPo article. Powell's filing not only makes clear that she does believe her claims; it also presents evidence that she believes to back up her claims. Her legal argument is that even IF she did make her claims without evidence, it was political opinion and as such is protected free speech. Her defense then further states that if her claims were the outlandish wild accusations as the Plaintiff claims them to be; that no reasonable person should have believed her assertions and thus are not defamatory. That is a classic defense argument. Old D shoots holes in their own legal proposition. Things that are "crazy", "outlandish", and "unsupported by evidence" are not likely to be believed by "reasonable people" and therefore, cannot be construed as actually damaging or defamatory. Old D can't have it both ways.
