This is true, however, as previously stated ignorance is no excuse in the court. It is the hunters responsibility to know what the rules and regs are. Like I said earlier, I think I can visualize exactly how it played out. I also know that I have seen similar sitiuations where people got hammered worse in court than he did (not referring to my earlier example only) I guess what really floors me is the inability he has displayed to simply abide by the terms of his probation. Being a high profile individual in the industry, it would seem to me that he would take no chances. That has proven to not be the case which makes me question the guy.
FTR Dan I don't argue that the jail time for the offense, especially considering the deviants that walk the streets due to reasons you have already stated, is not skewed in relation to the crime. However that is the law here and comparitivly speaking I have seen people get worse for equal offenses
Yes, could be a doe doesn't matter. Would the case have attracted as much publicity? Absolutely not, but the same goes for J Q Public vs Hunting celeb
Would he have filmed himself shooting a spike? Without the video evidence of the buck being shot, I don't think the state had much of a case against him.
Perhaps..... poaching, road hunters in particular, are a real problem around my property. I don't care if they are shooting a big buck, doe, or a pheasant. It is the same to me. I don't think that Spook in any way set out to poach a deer. I do think he failed in informing himself. Which in and of itself surprises me considering who the guy is. Did they make an example out of him? In some respect yes, BUT not in the severity of his sentenceing IMO as it was a common sentence for the crime in this state. I do think that they publicized it more because of who he is.
When I said you would be in the .1% I was talking about the deer being a doe or small buck in this case only. Not road hunters and other poachers. Those people suck, no matter what they're shooting.
So how many does were tagged illegally in 2012,2011,2010,2009 in KS? I do know of a spike shot in Wisconsin over bait by a hunter, but I have no idea how many deer were poached in MI that do not have a lot of head gear. If I thought hard enough I could name few of the hunters the past five years who poached a buck.
Clearly no one knows, 100's ?? 1000's???? I'd bet it is more than two... to me it doesn't matter what it is as I already stated. How many upland game birds are poached? How many bobcats are killed without being reported and tagged??? The list goes on... We also don't know how many trophy bucks were tagged illegally in KS or not tagged at all. Doesn't make any of it right. I know a guy who got busted shooting a doe out of season a few years ago... HE PAID DEARLY FOR IT!!! Truth be told the guy had lost his job and was hard up, he truly was trying to get some meat for the table. I felt bad for the guy but when it comes down to it he broke the law. He told me he was too proud to ask for help (food bank etc) I would venture to say once his name was smeared in our local papers he wasn't too proud anymore
That's awesome! It's almost impossible to catch poachers red-handed, especially with the lack of CPO's. The ONLY deterrent is stiff penalties.
I would be curious to know how many people, who will/would/are throwing spook under the bus for this, have driven home from a bar over the influence in their life, or who smoked marijuana, or anything else. None of us are perfect. The guy screwed up, he got caught. Personally, I agree with Dan. A deer is just a deer, fine him? Sure. Revoke his license? Sure. Jail time? Not when there are so many worse crimes that should end in jail time
