My brother was in a similar situation last year his buck ran less than 200 yards onto the neighboring property's we would later find out. We went to ask the owner permission to track him and to are shock she said no. We were considering going out there anyway because we knew he hadn't gone that far but we decided that would be plan B. My brother decided to call our local game warden and he explained the situation to him. Within the hour he was out there with us on the property line and he started to track the deer onto the neighbors property and even drug it back to our property for us. Sadly, my thought too was the land owner went out and got it later on. How close is a neighboring property that it could have crossed over on? If close, I'd go ask them to see if you can find it. Never know, land might not be posted from that side
It's the landowners call, you're at his mercy. If you don't like it then stop hunting there. He was probably not happy about a buck being wounded and running off any more than you were.
Sounds like he wanted your deer for himself. Did you have a signed lease with him and pay for hunting rights? If you found out he recovered the deer, you may have a case for breach of contract. I am not a lawyer but, if that is the case it may be worth talking to one to see if you could get your money back.
This I find troubling that a warden who is supposed to uphold the law would break it. It is private property and even thou the land owner is a D bag this doesn't give them the right to enter the property. He should have went to her first and try to persuade her to let you in accompanied by him and if she still said no then take appropriate action. I had this happen last year to me I shot a buck on public and it went to private but they granted me access to the property but came along for the ride and when they thought we did enough they called the search. Not much I could do I still needed to be on good terms with them just in case it happened again. Again private property it's theirs and how messed up it is they do have the final say.

Agreed, game warden doesn't need land owner permission to enter private property . I am unsure though if private landowner has to grant permission for search / recovery even with game warden assistance . For some reason I think something changed with this a while back but I t cant remember for sure I am referring to Illinois . Anyone else have info on this ?
I still find that disturbing, they are government agents so why don't the bill of rights and constitution pertain to their job. Probable cause is a loose term but with this land owner they did nothing illegal so there is no probable cause. Government overreach pisses me off.
I'll have to check up on it, but I know there was a bill introduced that would limit their capacity in certain circumstances. Think it was more for seizure of property more than anything. Was actually a lobbyist that was stopped on private property. Think it was having an operable bow on his 4 wheeler or something to that extent. They ticketed him and apologized, saying something like "sorry we only enforce the laws, we don't write them". To which he replied, "that's OK, because I do"
Does this landowner/friend require you to notify him every time your hunting and where on the property? Maybe you could just go out hunting to where you were searching, and...... You know, walk around for awhile looking for the perfect spot to sit?
In MO, a warden is automatically granted permission to enter a property if there is purple painted on the property boundaries.
