Does anyone have a generic Landowner agreement form that myself and guests could copy and sign that would protect the landowner from any lawsuits should I or one of my friends do something dumb an injure ourselves on his property while hunting? I'd just like to make sure his kindness to let us hunt on his land cannot come back to bite him. I know some clubs have insurance with their yearly dues but I'm looking for a legal letter or form we would just sign each year. Thanks all
Double check state laws too. In Illinois the landowner has full protection now from what I understand. With or without liability waiver.
In Wisconsin, there is a dollar amount attached to it. I think it is full protection if the landowner accepts <$2k.
Every state is different and most "legal agreements" are only as good as the lawyer that is supporting/opposing it. Here in Vermont, if the land is posted, the landowner is liable. If the landowner gives you permission, they are liable. If someone trespasses, unless the landowner has some "knowingly dangerous" situation, they are not liable.
I think this will work out well. Thank you. The owner didn't ask for anything but I just want to watch his back.
Good job looking out for landowner. That makes it easier on guys like us that depend on permissive opportunities.
Interesting. Can someone post the one of these state laws that protects a land owner from litigation. Doesn't seem to make sense. I believe any land owner weather you own a postage stamp size lot or thousands of acres you can be held liable the second someone steps on your land. Waiver or no waiver a land owner can be dragged into court and have to pay lots of money just to defend himself. The only true level of protection is a solid insurance policy that will protect your assets.
