Defended myself against a trespasser

    Hi everyone this is my first post. I was warned by my new neighbors where I had purchased my new land after selling my farm about a guy who just goes on peoples land, shoots deer and brags about it at the bar. I told him when I met him a year ago to spread the word I don’t tolerate trespassing. Anyway I caught him on my land and my contractor was with me and the guys dog(air dale) walked on my new concrete. I asked the guy nicely you need to leave and I like my privacy respected.
    He started swearing and using the F bomb and gets in my face. I said we can do this the easy way or the hard way but you are leaving. We went back and forth and I kept my cool and emotions. I asked him six times to leave and started to call the sheriff and that is when swung at me. I blocked it and struck him with a ridge hand strike on the temple and he dropped and laid on the ground. I broke his glasses and he screamed my god you hit me. He had swelling by his eye. I said yes I did, it was self-defense and you swung at me. I said leave now. He shook his fist at me and I said you swing I am going to knock you out. He left and said don’t take this to court the sheriff is my friend. I said I will see you in court. The Deputy came and I and my contractor filled out statements. Trespasser plead guilty in court to trespassing $262.00 and I have to go to court on 18th of October for the assault charge. The DA said if he comes back on my property he will issued a $700.00 fine and restraining order. Deputy told me if you have a pistol you may want to carry it. I told him I already do. The neighbors have been giving me maple syrup, vegetables, pie and a dinner. I was informed I put down a bully and he needed it for years.
    In the future I will use my cell phone as a voice recorder after I call the sheriff and I am putting more cameras in my woods. Well the word has spread I don’t tolerate trespassers and I prosecute. Sometimes you just walk up on a trespasser as I did. Main thing is keep your cool and only use force when necessary. Extra protection hopefully is never needed but may not be a bad idea. I never expected the trespasser to attack, but he did. This happened in Wisconsin.

    Sounds like problem solved :-)

    So what's the deal with the assault charge - guessing it's just a formality and the DA won't be pursuing charges? He pleaded guilty to tresspassing and you have a witness so he can't have any leverage - was just surprised to hear there was even a court date at all....

    Ignorance is one thing but to get in your face in front of your help is another, glad you didn't over abuse your limit's. Once is usally good enough for a bully, unless he's with his buddies, then you can expect a retaliation. He'll have hurt feelings for a while then he'll rethink the situation over and hopefully react in the proper way! Bullies can't take humiliation! Good luck in court,hopefully the judge rules in your favor of self defense!

    Good for you! Sometimes you gota do what you gota do.

    I told a coon hunter once that I didn't want him or his dogs running my land. He told me that his dogs couldn't read signs. I asked him if his dogs could run fast. He said they could. Then I asked "faster than my .270?" Never seen or heard from him again.

    Sounds like a good result all things considered so far. I am not clear on the assault charge - against you or him? I have had several similar confrontations and thankfully none came to violence at all but a couple were pretty tense.

    Yes the assault charge is on him and one of my good neighbors decided he is coming to court with me. I said its ok you don't have too,and he said no I want the trespasser to know the neighbors are watching him. I thought that was pretty nice of him.

    I've had to confront more of these jackwagons than I care to recall...this entire area is covered in them. I had a reputation of being the @$$hole around here because I don't tolerate trespassers or road hunters or spotlighters or the occasional truckload of drunks trying to pour out of a couple of puckups intent on condicting a deer drive on the creek on my property. Never have had a confrontation come to blows yet but a couple of pretty heated shouting matches.

    People love to take advantage of your hard work if you'll let them....it's far easier and faster than for them to do the work for themselves.
